Deputies shoot, kill Carroll Co. man toting pellet rifle

A call came in to police at 10:38 p.m. for reports of a suspicious person with a rifle in a resident's backyard.

TEMPLE, Ga. - An investigation is underway after two deputies shot and killed a man outside of Temple, Georgia late Monday night.

The GBI posted this Tweet at 1:21 a.m. on Tuesday.

Investigations revealed that the man who was shot and killed by two Carroll County deputies was a 33-year-old white male, later identified as David Willoughby.

A call came into police at 10:38 p.m. for reports of a suspicious person with a rifle in a resident's backyard in the 60 block of West Lakeview Drive.

When deputies arrived, they found Willoughby in a woodline pointing the weapon at them. When he didn't follow instructions to put the weapon down, both deputies shot him.

Willoughby was taken to Tanner Medical Center in Villa Rica, Georgia where he later died.

Further investigations showed the weapon that Willoughby was walking around with was a pellet gun, according to the GBI. Police also said Willoughby's father lives in the neighborhood.

However, this is not the first time neighbors have reported Willoughby for his strange behavior. A neighbor whose wife was home at the time of the incident said she heard about three shots fired at around 11 p.m.

Kevin Boswell said his wife was in bed when she heard tires screeching and then woke up to gunshots being fired. When she went to look outside, officers who were at the scene at the time told her to stay inside.

Boswell said he had seen Willoughby walking up and down his street from time to time carrying some sticks or sometimes a shovel and talking to himself.

"For this guy to shoot a cop, just think what he'd do to a kid or a person in their own yard," he said.

Boswell has three children, ages 1, 5 and 6 years old.

"I've done been home and walked around the house and put flashlight around my home to see if there's any bullet holes, but still, not even being 100 feet from my house, concerns me very bad," he said.

Boswell had only been living in that area for a month and a half and this recent incident has him concerned for his family's safety.

"Me being on the road 24 hours, seven days a week, what am I supposed to do if I pull up and my house has been shot up with my kids killed or injured and have to go to the hospital?" he said. "Yeah, I'm very concerned and I wished that Carroll County would stick on this area a lot more than what they do."

He also said his house had almost been broken into less than two weeks ago but the would-be burglars were unsuccessful because Boswell had put a deadbolt on his door.

It's not Willoughby's first run-in with police in the area, however. Around 6:30 a.m. on Nov. 12, he was arrested for aggravated assault, terroristic threats and acts and public drunkenness for pointing a .410 gauge shotgun at a neighbor he didn't know while walking past his house.

Willoughby admitted to the crime and, according to the police report, said he woke up in a bad mood. The responding officer that day said that he could smell alcohol and that Willoughby's eyes were glassy.
