Authorities said they don't plan to file charges against a father who shot and killed a man who allegedly shot his daughter Sunday morning.
The gunfire erupted shortly after 4:30 a.m. at a home on the 3400 block of Jet Wright Road in Gainesville.
According to the Hall County Sheriff's Office, 25-year-old Thomas McNulty shot his 22-year-old girlfriend Jessica Rusk in the back after an argument. The couple, who have a small child, shared the home with Jessica's mother and father, who were both at home during the shooting. It was Jessica's mother who called police after McNulty fired his gun.
Floyd Rusk, Jessica's 57-year-old father fatally shot McNulty shortly after that. He died on the scene.
"Obviously violence would be the last resort," said Lt. Scott Ware of the Hall County Sheriff's Office. "If you can avoid violence and call 911, you know, we would obviously prefer that no one get hurt. That would be the best case scenario."
Rusk was taken to the hospital where she is listed in stable condition and is expected to recover.
Meanwhile, neighbors who spoke to 11Alive said while it's a sad situation, they understand by Floyd pulled the trigger.
"If that was the same situation with us, and somebody hurt our daughter, you know, we're gun owners and we'd probably do the same thing," they said.
At this point, no charges have been filed against Floyd, however the District Attorney will review the case and make the final decision whether on whether he'll face any.
