'What do I say? What's the plan?' Police testify in Tex McIver murder trial

Thursday was day 8 in the high-profile murder trial of the Buckhead attorney.

ATLANTA — Several police officers who responded to Diane McIver’s fatal shooting took the stand on Day 8 in the murder trial of her husband, Tex McIver.

Tex McIver is accused of intentionally killing his wife, Diane, on Sept. 25, 2016, who died after being shot in the back with a handgun while in the passenger's seat of an SUV.

Her husband was riding behind her and had a loaded revolver in his lap and, according to him, the revolver fired on its own and claims that the shooting was "a horrible accident."

Among those taking the stand on Thursday were Emory police officer Frank Stroupe, who retook the stand from Wednesday, as well as Atlanta police officer Brian Ricker, and investigator Malik Robeson-Els and homicide detective Jamael Logan, both also with Atlanta police.

After the shooting, Stroupe said he recalled McIver ask his lawyer, Stephen Maples, “What do I say? What’s the plan?”

The prosecution and defense took all of the witnesses through detailed accounts of what happened after they responded to reports of the shooting.

McIver faces murder, felony murder, aggravated assault with a deadly weapon, possession of a firearm during a felony and three counts of influencing witnesses.
