ATHENS, Ga. – Three former Athens high school students have been cleared of almost all charges in a sexual assault investigation involving a 15-year-old girl.

Xavier Clarke, Markel Brannon and Javious Collins were indicted February 2016 on charges of rape and false imprisonment after a fellow Cedar Shoals High School classmate, a 15-year-old girl.

The student told police the three attacked her in a stairwell, but at the time, at least one of the suspects told police the encounter was consensual. She immediately reported it to school officials after it happened.

A surveillance video camera in the stairwell caught the encounter and charges were filed based on what the video showed. However, on Nov. 21, a grand jury decided to drop all charges against Clarke, Brannon and Collins after jurors re-examined new evidence and found there was not enough to charge them.

The three still face child molestation charges.
