THE WELLSTAR WEIGHT LOSS CHALLENGE
OFFICIAL CONTEST RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, "WellStar Weight Loss Challenge" (the "Contest") is open to legal U.S. residents of the State of Georgia who are 18 years or older at the time of entry. Employees and contractors of WXIA-TV ("Sponsor"), WellStar Health System, Good Measure Mealsâ„¢, Master Performance, Inc., Gannett Co., Inc., and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees or contractors, are not eligible.
3. How to Enter. The Contest begins at 8:00 a.m. (E.T) on January 23, 2012 and ends at the selection of the Grand Prize Winner on May.25, 2012 (the "Contest Period"). All entries must be received by 8:00 p.m. (E.T.) on February 12, 2012.
Enter by visiting the "WellStar Weight Loss Challenge" official registration pages: www.11Alive.com or www.atlantaandcompany.com , completing all of the required information and following all instructions. Each entrant must submit their entry by clicking on the "SEND" button. As part of the entry form, each entrant must upload at least one current photograph, taken within the previous twelve (12)-month period, with a written explanation in English and of no more than 50 words of the reasons the individual should be selected to participate in the Contest. Entries or photos submitted directly to WXIA-TV will not be accepted. Each photo submission and written description must be an authentic, original photograph and description, and the Contestant must own the copyright in the photo and description. Contestants certify that individuals other than themselves shown in the photos have been informed that their photo has been entered in a Contest and have no objection to the submission and Sponsor's display and posting of such photo for the purposes of the Contest. All digital entries should be at the highest resolution possible. Sponsor will accept the formats of jpeg and tiff. Sponsor reserves the right to disqualify or withdraw any entry that is alleged to infringe on any third-party's intellectual property rights, or that Sponsor deems to be obscene, offensive or otherwise inappropriate for viewing by a general audience. Neither the photo nor description submitted may have been previously published. Your computer must accept cookies, or any successor or similar technology that may be used for the purpose of entry tracking. Ad blocking software on your computer should be disabled so that it won't interfere with processing your entry. Complete all required fields on entry form and submit your entry by clicking on the "SEND" button. Limit one (1) entry per contestant. All entries must be received by 8:00 p.m. (E.T.) February 12, 2012.
All entry materials become property of Sponsor and will not be returned. Each contestant agrees that Sponsor shall have the right, in its sole discretion, to post any submitted photo online on www.11Alive.com. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any telephone connection, network, hardware or software, whether originating with sender or Sponsor.
All contestants must be willing to be available to be interviewed during the Semi-Finalist selection phase (details below), and allow Sponsor to conduct a background check. Finalists (as defined below) will need to be available for multiple appearances on Sponsor's programs identified below on dates selected by Sponsors. Sponsors will inform Finalists of the appearance schedule but reserve the right to change the schedule. Finalists must be available for Sponsors' related publicity and promotions.
4. Winner Selection. SEMI-FINALISTS: Twelve (12) entrants will be selected as semi-finalists (individually, "Semi-Finalist" and collectively, "Semi-Finalists") on February 13, 2012 by a committee of Sponsor representatives, based on all eligible entries. Entrants will be notified by telephone and e-mail by a Sponsor representative. On Thursday, February 16, 2012, each Semi-Finalist will be required to appear in person at Sponsor's business office at One Monroe Place, Atlanta, Georgia 30324 for a thirty (30)-minute interview. Sponsor will inform each Semi-Finalists of the specific time period designated for its interview. During the interview process, Sponsor representatives will evaluate each Semi-Finalist's level of commitment, motivation, and reasons for participating in the Contest. At the interview the Semi-Finalists will be informed of the requirements and obligations required if selected as a Finalist. If any individual has a food allergy or sensitivity, he/she must either provide Sponsor with a release from a medical doctor or waive participation in Good Measure Mealsâ„¢ ("GMM") meal plan prior to the selection as a Finalist.
FINALISTS: Based on the Semi-Finalist evaluations, Sponsor will select twelve (12) Semi-Finalists as Finalists (each, a "Finalist" and collectively, "Finalists"). The Finalist phases shall begin on March 5, 2012 and end at the selection of the Grand Prize Winner on May 25, 2012. During the Finalist phase, Finalists will be divided into two (2) teams but each Finalist will compete individually for the Grand Prize. Each of the 12 Finalists will be required to: attend a luncheon meeting on Wednesday, February 29, 2012 at WXIA-TV's business office from 12:00 Noon (E.T.) to approximately 2:00 p.m. (E.T.) At the luncheon, Finalists will receive the following: (1) a schedule of dates for appearances on selected Sponsor programs; (2) an initial weigh-in; (3) registration for GMM meal plans at no charge to Finalists (ARV: $100.00 per week per Finalist); (4) introduction to their designated exercise trainers from Master Performance, Inc., 230 Hammond Drive, Sandy Springs, Georgia (ARV: 1,200 per Finalist); and (5) provide proof of valid and current health insurance. All Finalists must submit to a general health screening at WellStar Hospital in Atlanta, Georgia, on Thursday, March 1, 2012 from 7:30 a.m. (E.T.) to 12:00 Noon (E.T.). Health screenings will test body fat, blood pressure, lipid panel, comprehensive metabolic panel, body composition, blood type, a heart and BMR analysis designed to assist cardiologist to determine level of risk for heart disease or future cardiac issues, and requires a 12-hour fast prior to the start time of individual screening. The screening is at no charge to Finalists (ARV: $40.00 per Finalist).
Finalists are encouraged, but not required, to consume GMM pre-prepared, packaged and proportionally-adjusted meals, provided by GMM for Monday - Friday meals at no charge to the Finalists. Finalists electing to accept the GMM meals are required to pick up them up at GMM pick up locations upon proper identification. GMM locations are listed on GMM's website, www.goodmeasuremeals.com/order/pickupLocations.aspx. (Allergen notification: certain GMM food products contained in its Contest meal plan may contain shellfish, fish, egg, milk, soy, wheat, tree nuts or peanuts. Finalists acknowledge and understand this possibility and are advised to not use the GMM meals if they have a life-threatening allergy to any of these food products.) Finalists shall be required to appear at WXIA's business office on alternate weeks for weigh-ins. Progress of the Finalists' weight loss, throughout the Finalist Phase, will be reported on Sponsor's programs, as selected by Sponsor, including the "11Alive News at 6AM" newscast, "11Alive News at 5AM" newscast, and "Atlanta & Company" program airing Mondays through Fridays, 11:00 a.m. (E.T.) through 12:00 Noon (E.T.), as well as on Sponsor's websites www.11Alive.com, and www.atlantaaandcompany.com. Finalists will be encouraged, but not required, to post news of their weight loss progress on www.11Alive.com, www.atlbiggestloser.com and www.atlantaaandcompany.com.
GRAND PRIZE WINNER: The Grand Prize Winner will be the individual who loses the highest percentage of weight during the Finalist phase as of the final weigh-in on or about May 25, 2012.
5. Prizes and Odds. Grand Prize: Grand Prize: One $750 RK & Company Jewelers gift certificate. (ARV: $750.00).
6. Grand Prize Winner Notification and Acceptance. Grand Prize Winner will be announced at the final weigh-in on or about May 22, 2012, which will be videotaped for broadcast on WXIA and its related websites on or about May 25, 2012. The Grand Prize Winner may waive his/her right to receive the Grand Prize. The Grand Prize is non-assignable and nontransferable. No substitutions allowed, except that prizes and individual components of Grand Prize package is subject to availability and Sponsor reserve the right to substitute prizes of equal or greater value. Prizes are not redeemable for cash. The Grand Prize Winner is solely responsible for reporting and payment of any taxes on prizes. The Grand Prize Winner will be required to complete an affidavit of eligibility/liability and publicity release which must be returned as instructed by Sponsor. Failure to sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in the Grand Prize Winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. __Except where prohibited, participation in the Contest constitutes Contestants' consent to the publication of his or her name, biographical information, photos, videos, and likeness in any media for any commercial or promotional purpose, without limitation or further compensation.
7. Participation. By participating, each Contestant agrees to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserve the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserve the right in its sole discretion to suspend, modify or terminate the Contest, or repeat the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserve the right to award prizes based on the entries received before the termination date. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries (either photos or poor quality photos, or for failure to receive entries or votes or other electronic communications due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries or the owner of an ISP account shall be determined by Sponsor in its sole discretion.
8. Copyright. By entering the Contest, each Contestant grants to Sponsor an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the Contestant's submitted entry, video, and/or narrative, photos or other recordings, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation.
9. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Georgia. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein.
10. General Release. By entering the Contest, contestants release WXIA-TV, WellStar Health System, Good Measure Mealsâ„¢, Master Performance, Gannett Co., Inc., participating advertisers, any other promotional Sponsor, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, medical complications or risks, losses or damages of any kind arising out of or in connection with their participation in the Contest, Contest or with the acceptance, possession or use of any service provided or prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
11. Sponsor. The WellStar Weight Loss Challenge Contest is sponsored by WXIA-TV, whose decisions regarding the selection of Semi-Finalists, Finalists, and Grand Prize Winner, and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
