FLAGSTAFF, Ariz. -- The Justice Department is suing Home Depot for firing an Iraq war veteran and National Guard reservist from its location in Flagstaff in northern Arizona.
The lawsuit, filed in federal court in Arizona on Thursday, alleges that soldier Brian Bailey was fired from his job at the home-improvement retailer as a department supervisor in May 2010 for his periodic absences from work because of his military obligations.
That would violate the Uniformed Services Employment and Reemployment Rights Act of 1994.
Atlanta-based Home Depot spokesman Stephen Holmes says the company fired Bailey for performance reasons unrelated to his military duties. He declined to provide specifics.
The lawsuit calls on Home Depot to declare that firing Bailey violated the law, pay him lost wages and benefits, and hire him again.
