Andrea Sneiderman files lawsuit against Hemy Neuman

FULTON COUNTY, Ga. -- The widow in the Dunwoody daycare murder case is fighting back against her accusers.

Andrea Sneiderman filed two lawsuits Monday -- one against convicted murderer Hemy Neuman, the other against her estranged brother-in-law.

Sneiderman is suing Neuman for wrongful death in the murder of her husband Rusty Sneiderman, who was shot to death outside his son's daycare in November 2010. A DeKalb County jury convicted Neuman of the murder in March.

In a separate lawsuit, Sneiderman is suing Rusty's brother Steven Sneiderman, alleging libel and defamation of character.  Steven Sneiderman publicly called Andrea Sneiderman a co-conspirator in the murder of her husband. Through her attorneys, Mrs. Sneiderman has denied any complicity in the killing.

Andrea Sneiderman is also asking the court to throw out a wrongful death lawsuit filed by Rusty Sneiderman's parents and brother.  Mrs. Sneiderman is named as a defendant in that lawsuit.

During Neuman's murder trial, prosecutors and defense attorneys said Andrea Sneiderman was involved in her husband's murder, but offered no direct evidence. Testimony indicated that Sneiderman and Neuman had a close personal relationship as coworkers, and that the married Neuman was obsessed with Sneiderman. Sneiderman denied that the relationship was significant.

However, her testimony raised questions about her prior knowledge of the killing. Two witnesses testified that moments after the murder, she informed them by phone that her husband had been shot, yet Sneiderman testified that she didn't learn her husband had been shot and killed until after she drove from her home to the Dunwoody Prep daycare center, then to the Atlanta Medical Center emergency room, where a doctor informed her of the details.

The Dekalb County District Attorney's office is still investigating Sneiderman. Several weeks ago, a grand jury requested a videotape of Sneiderman's testimony for review for a possible criminal indictment. However, Sneiderman has not been charged with any crime.
