Authorities say 53-year-old Vanessa Thrasher was preparing to testify in an upcoming murder trial when she was gunned down at O.T.'s Lounge and Soul Food Grill in northwest Atlanta on Aug. 16.
Fulton County District Attorney Paul Howard said that Thrasher was a key witness in the trial of a man charged with killing one of her employees in May 2011.
Police also arrested 23-year-old Otis Ricks Jr. a day after the shooting. And Gerald Peterson, 23, was taken into custody over the weekend.
Penson is the last of four suspects to be charged in this case. No word on when he will make his first appearance.
