SUWANEE, GA-- Back home with their mom, 9-year-old Ben Cleary and his brother Henry seem like any other children over the holidays.
Both are excited to open Christmas presents that sat under the tree well past December 25.
Henry also has birthday presents to open. He turned 8 earlier this week, but wasn't home to have his birthday party.
"We're so thankful and just want to move forward. They get to open their presents that Santa left for them, play with their friends and enjoy the last week of their winter break," said Nash.
The boys' mother, Theresa Nash, reported them missing ten days ago when she said their father failed to return them to her.
The boys' mother, Theresa Nash, said her sons visited the Tennessee Aquarium in Chattanooga with 46-year-old Daniel Cleary. He shut off his cell phone on Dec. 23 after making one final call near Nashville. Nash told 11Alive that her sons' father had also emptied his house, abandoned his car and purchased a gun, and she had feared for her children's safety.
Authorities issued an Amber Alert and later released pictures of Cleary and his sons shopping at a Walmart in Tennessee.
On Saturday, authorities say a citizen in Austin, Texas recognized Daniel Cleary and his sons from the Amber Alert on the news and called police.
Officers arrived and saw Daniel Cleary and his two sons, Ben and Henry Cleary, exiting a hotel room at Crossland Economy Suites in Austin. They took Cleary into custody without incident. The boys were not harmed.
Austin Police say they also recovered a handgun and a large sum of money.Daniel Cleary is being held at the Williamson County Jail. He faces a charge of interstate interference with custody, which is a felony.
