SUWANEE, Ga. -- The Gwinnett County district attorney is reviewing whether charges should be filed after a kindergarten student told his parents he was touched inappropriately by another student.

Gwinnett County Public Schools confirmed to 11Alive that the incident happened on Oct. 31 in the Level Creek Elementary School gym.

"A kindergarten student inappropriately touched another kindergarten student. That student reported this to his parents on November 7 and they brought it to the school's attention. The school conducted an investigation,” Gwinnett County Schools spokesperson Sloan Roach said in a statement.

The alleged act is so disturbing the case has now been referred to the district attorney's office.

School officials said the resource officer who took the report said that because of the age of the children, he does not believe the accused should face criminal charges.

The district attorney’s office has not made a decision.

School officials contend, using school policy, they've already disciplined the kindergarten student appropriately.
