JACKSON, Ga. (AP) - A lawyer for a Georgia death row inmate is asking a state court judge to halt his client's execution, which is set for Monday.
In a filing Wednesday in Butts County Superior Court, Brian Kammer argued Warren Lee Hill is mentally disabled and shouldn't be executed. He asked the court for a stay to give him a chance to argue his case. Kammer has filed similar requests with the U.S. Supreme Court.
Hill was serving a life sentence when he was convicted in the 1990 death of a fellow inmate.
The state has argued the defense failed to meet its burden of proving beyond a reasonable doubt that Hill is mentally disabled.
Hill's execution was scheduled for Wednesday but was delayed after the state announced changes to its execution procedure.
