Good samaritan chases hit and run driver

DEKALB COUNTY, Ga. -- When L.C. Wheat watched a car crash into an oncoming motorcycle his first thought was that, of course, the driver would stop.

"I couldn't believe it.  I could hear a passenger yelling 'is he dead?', but then the driver just took off.  I jumped in my car and followed him," said Wheat.

Police identified that driver as 60-year-old Toney Smith. He is charged with hit and run, driving under the influence, driving with a suspended or revoked license and making an improper left turn.

The motorcyclist, 30 year old Jose Santiago-Maldanado was killed.

It happened Sunday evening at the intersection of South River Industrial Drive and Moreland Avenue.

"The guy on the motorcyle didn't even have a chance to hit his break The guy in the camaro was driving pretty fast. The bike just  disintegrated into pieces," recalled Wheat.

While chasing the driver, Wheat called 911 and eventually officers joined in and pulled over the driver on Bouldercrest Road and Cedar Grove Road.

It is likely Smith will face an added homicide charge.
