ATLANTA -- Delta Airlines is being accused of violating people's right to privacy.

In a lawsuit, California's attorney general claims the airline doesn't warn customers that its "fly delta" app collects their names, addresses, birth dates, and credit card information.

This is believed to be the first-ever privacy lawsuit filed against smartphone app maker.

A delta spokesperson says the company's policy prevents him from commenting on pending litigation.
