MACON, Ga. -- Prosecutors have filed a new indictment against a man accused in the death of a Mercer University law student.

McDaniel charged in Giddings' death

The new indictment was filed Tuesday in Bibb County Superior Court. Stephen McDaniel was initially indicted in November 2011 in the June 2011 slaying of his classmate and neighbor Lauren Giddings.

Both indictments include one count of murder. The first said McDaniel decapitated Giddings, while the second doesn't.

District Attorney David Cooke says prosecutors decided to refine the indictment in light of recent Supreme Court decisions.

Cooke says the new indictment shouldn't delay the case, which is set for trial Jan. 6.

Police discovered Giddings' torso in a garbage bin outside her Macon apartment building. The rest of her remains haven't been found.
