Police have confirmed that the suspect in the murder of Barney Simms has been apprehended.
Officers said that Eric Banks, 17, was caught in connection to the April 9 shooting and is being charged with murder.
Atlanta Police said Banks was the mystery man pictured at the Waffle House with Simms. The prominent city leader was found gunned down in his front yard on Connally Drive in southwest Atlanta.
Police said Banks and Simms walked into a Waffle House on Virginia Avenue with no apparent conflict. Simms was found murdered less than an hour later.
"We don't have any information as to what the relationship is, if there's one at all," said Maj. Adam Lee III. "All we have as far as them even ever being in the same company was the video we retrieved from the Waffle House."
Simms was an active civil servant in the southwest Atlanta area.
When police arrived to the scene, they found him slumped over in the front yard. Investigators said the suspects stole his car, which was later recovered.
Police said they have established a motive but aren't releasing any details.
