Motion denied to dismiss charges against officer accused of killing unarmed Veteran

DEKALB COUNTY, Ga. -- A DeKalb County judge rejected a former officer's motion to dismiss all charges against him in a shooting that left a Veteran dead three years ago.

Robert Olsen is accused of killing Air Force Veteran Anthony Hill in March 2015. Authorities said Hill was naked and unarmed when he was shot. His family said he was dealing with post-traumatic stress disorder.

Olsen said he acted in self-defense.

He was facing a six-count indictment: two counts of felony murder, one count of aggravated assault, one count of making a false statement and two counts of violation of oath by a public officer.

Tuesday, a Judge rejected his motion to dismiss the charges.

"Defendant was unable to show that it was reasonable to believe that Hill was about to kill him, inflict great bodily injuring upon him or a third person, or commit a forcible felony," the Judge's ruling said.

In May, an immunity hearing was held, and it took nearly three months for the decision to come down.

The judge pointed out that Olsen is 5 inches taller and 40 pounds heavier than Hill, and had police training, as well.

Hill's girlfriend celebrated the news on Twitter, saying "We are finally moving to trial after 3 long, grueling, anxiety-ridden years."

It's unclear when the trial will begin.
