Man shooting into water truck stopped by police bullet

The man allegedly pulled out a weapon and started shooting into the truck. Smyrna police responded and, according to Harvey, instructed the man to put his weapon down.

SMYRNA, Ga. -- A gunman is in the hospital after being shot by a Smyrna police department officer Thursday morning. 

It happened around 11:45 a.m. at a business on Village Parkway near Lake Park Dr. in Smyrna.  

According to Smyrna Deputy Police Chief Robert Harvey, this started when the man, identified as 68-year-old Gary Fink, saw a water delivery truck. 

“He started making exclamations that he did not like that particular water and started pulling water bottles out, which were made of glass,” Harvey said.

When someone intervened, it escalated. 

Fink allegedly pulled out a weapon and started shooting into the truck. Smyrna police responded and, according to Harvey, instructed Fink to put his weapon down. When he didn’t, that’s when an officer shot him one time. 

Fink was taken to the hospital and his condition is not known, however, his injuries are not life-threatening. 

Both of the water delivery employees were not involved because it happened while they were making deliveries, police said. No one, other than the suspect, was harmed.  

The Georgia Bureau of Investigation is leading the investigation into the shooting while Smyrna police are investigating the vandalism of the water truck. 

The is the 16th police shooting investigated by the GBI this year.
