ATLANTA — A suspect has died after investigators said he pulled out an assault rifle outside a southwest Atlanta restaurant where a Fulton County deputy was working part-time.

The incident happened outside The Ivory Restaurant located at 599 Whitehall Street, SW at 4:50 a.m. The deputy was working security at the restaurant and was not injured.

The suspect, identified as 46-year-old Norris Duffy, was in serious condition earlier in the day but has since died. The GBI has been called in to investigate.

Authorities said the suspect was involved in a fight in the restaurant earlier in the morning and was tased before leaving.

It was after this that an off-duty deputy noticed him brandishing an assault rifle outside his car. The deputy then opened fire.

According to the GBI, three deputies were working an off-duty part time job at the restaurant.
