VERIFY: Is it legal for district to fire bus drivers after sickout?

Here's the answer.

After a large-scale "sick-out" by bus drivers across the DeKalb County School district, several drivers found their jobs on the chopping block.

And DeKalb School Superintendent Dr. R. Stephen Green said more terminations could be on the way, after more than 350 of the system's 908 drivers did not show up for work Thursday morning. A smaller number of drivers--224--were "no shows" on Friday.

After a community meeting Thursday night, Green called the drivers' actions "inexcusable."

QUESTION

11Alive wanted to know: Was it legal for the district to fire those bus drivers?

ANSWER

Yes.

EXPLANATION

11Alive spoke to the Department of Labor who directed us to DeKalb County since the state doesn't regulate sick policies. So, it's left up to each employer.

11Alive asked DeKalb County Schools about their policy and it's clear that "a physician's certificate may be required by the superintendent or his or her designee at any time deemed necessary."
