The Tex McIver case: 'Tex, you shot me' | Episode 1

Episode one of 11Alive's 'Intent' examines the night Diane McIver was shot and killed, along with the prominent Atlanta community her and her husband called home.

Late at night on Feb. 27 1990, gunshots ring out on a quiet, residential street in Northeast Atlanta.

Moments earlier, Claude McIver III - or Tex as most knew him - arrives home to let his dogs out. As he steps out of his vehicle, there's a gun is in his hand.

In a Mustang in the cul-de-sac, sit three young men, two of whom would tell police they saw Tex pull out his weapon and fire; first two shots in the air and then two more in their direction.

The driver of the Mustang pulls away, driving off. One of the bullets strikes the gas tank of the car, but the three men inside escape without injury.

An attorney for Tex later claimed that the act was of self-defense, that he was "fearful." However, the charges against him are serious enough for Tex to undergo a psychological evaluation.

He wasn't found to have any aggressive tendencies, and as a result, the incident simply goes away as if nothing ever happened.

Privately, the matter is settled. But that story, buried back in the 90s, would resurface over a quarter century later as Tex found himself at the center of another shooting, one that would involve the woman he was married to at the time.

In September of 2016, a simple car ride would become the scene for a deadly shooting involving Tex's wife, Diane McIver. 

The two were out for a fall weekend trip at their Putnam County ranch, along with their friend, Dani Jo Carter.

On the drive back, Carter took the wheel, with Diane in the other front seat and Tex in the back - his gun in hand. At some point in the trip, the gun went off, piercing the seat where Diane was sitting. 

Where the story goes from there would become the subject of much controversy, as Tex made the decision to take his critically injured wife to Emory hospital, instead of one closer to their location.

Once at the hospital, Tex is asked by nurses and hospital staff what happened. His answer? It was an accident.

Diane would ultimately not survive the night and was pronounced dead in the early morning hours of Sept. 26.

As news of her death spread among friends of the couple and the community they lived in, Tex's story would continue to draw further suspicion.

On this season of 11Alive's true crime podcast, titled "Intent: The Tex McIver Case," reporter Kaitlyn Ross will explore the case of Diane McIver, the wealthy businesswoman who was shot in the back by her husband of 11 years.

Listen as Ross pieces together what led up to the shooting and tries to figure out whether this really was an unthinkable accident - or something else.
