Prosecutors call into question updates to Tex McIver's will following wife's death

McIver faces murder, felony murder, aggravated assault with a deadly weapon, possession of a firearm during a felony and three counts of influencing witnesses related to the case.

FULTON COUNTY, Ga. — Week three of the Tex McIver murder trial just kicked off, and during Day 10 of court proceedings, prosecutors drew jurors' focus to Tex's will following his wife Diane's death.

Tex McIver is accused of intentionally killing his wife, Diane, with a loaded handgun while riding in the backseat of his SUV on Sept. 25, 2016. She died after being Tex said the gun fired on its own, shooting Diane through the front passenger's seat of an SUV. He claims that the shooting was "a horrible accident."

On the stand Monday afternoon was Anne Schwall, a friend of Tex and Diane's, and the mother of their God son, Austin.

After Diane was shot by Tex's gun, Tex reportedly updated his will to leave all of his estate to their 11-year-old God son. Schwall testified that Diane told her she wanted to leave their Putnam County ranch to Austin, but her will had not been updated since 2006, before Austin was even born. Schwall told jurors Tex told her he updated his will on his late wife's wishes.

"He told me that his biggest regret was they did not get a chance to update their wills," Schwall told the court.

Testimony also revealed Tex updated his will to leave $500,000 to his oldest son, Robbie, who was allegedly not interested in the ranch. However, Tex completely left out his other two grown children.
