Claud “Tex” McIver will be back in court Tuesday morning for a pre-trial hearing.
McIver, a prominent Atlanta attorney, faces murder charges for the September 2016 shooting death of his wife, Diane McIver, president of Corey Advertising.
McIver claims the shooting was accidental. The 74-year-old said he fell asleep in the backseat of a car with a loaded gun in his life when it accidentally went off, killing his wife.
McIver was most recently in court last week to request bond to visit his sick mother, though no ruling was made on his request.
Judge McBurney has also yet to rule on whether several boxes of financial documents submitted as evidence were obtained legally.
McIver's murder trial is slated to begin Oct. 30.
