Financial expert called Tex McIver 'cash poor' when his wife died

A forensic accounting expert also testified that Tex was about $5,000 in debt when his wife died.

FULTON COUNTY, Ga. — An Atlanta attorney was called “cash poor” on Day 12 of his murder trial.

Tex McIver is accused of intentionally killing his wife, Diane, with a loaded handgun while riding in the backseat of his SUV on Sept. 25, 2016. She died after being Tex said the gun fired on its own, shooting Diane through the front passenger's seat of an SUV. He claims that the shooting was "a horrible accident."

Tex was “cash poor” when his wife died, according to Dean Driskell a financial expert who testified on Wednesday.

A forensic accounting expert also testified that Tex was about $5,000 in debt when his wife died. The expert said Tex spent $63,000 more than what he brought in during the nine months before Diane was killed.

“There was more money going out than coming in and it wasn't going to savings accounts, tt was spent on living and the ranch,” Driskell said.

It was revealed during testimony on Tuesday that Tex had taken a $350,000 loan from Diane and was struggling to pay it off.

The defense said Tex’s financial problems are exactly why he would not kill his wife intentionally since he relied on her income to fund his lifestyle.
